In administrative proceedings at the National Institute of Industrial Property (Inpi), Diageo accused the company of "imitation" of your brand.
Cachaça João Andante and his character, according to the UK brand, were literal translations of mark and Johnny Walker logo.
"We've N.d. 'd the elements of our visual identity, but we seek to maintain the charisma that we conquered," says Magnus Casas, one of the partners of the cachaçaria.
In the new phase, the production of cachaça comes out of Hobby, in the West of Minas Gerais, and goes to Parrots, in the metropolitan region. The change will raise the production capacity of 3 000 to 4 000 litres per month for 10 000 gallons per month.
Despite the defeat to Diageo, the partners say they did not commit plagiarism.
They protect the Pto's own opinion, that there would be no confusion between the two marks, "because of the type of consumer public, specialized enough to distinguish between the brands and the products marked by these".
