Restaurants will rise 13% service charge

São Paulo – With the entry into force on the day this month, 15 of the law which regulates the collection and assessment of the tip, the restaurants are articulating for increase in service fee set-passing of current 10% to between 12% to 13%.
The move is widespread in the industry, according to the General Counsel of the National Association of Restaurants (ANR), Carlos Augusto Pinto Dias. "The vast majority of restaurants will implement this increase, but will not be uniform. Should vary between 12% to 13%. "
One of the '' houses '' that will change is the Insalata, located in the gardens, in the capital of São Paulo. According to the restaurant''s partner, Fernando Daher, the new value will be 13% and will be worth at 15 day of this month (same date the 13,419/2017 Law enters into force). The change will be worth also for another unit of the company, the Insalata Terrace.
The partner of the consulting firm specializing in business, no, Léo Teixeira says that the modification has been articulated by his own '' houses '', within the zone in which they operate. "It is a movement of the restaurants are talking between them and articulating to change it together. And will even, the entire market will change once. "
Reason of the increase
The movement takes place on account of the increase in payroll taxes, social security and labor that will come with the law 13,419/2017, since the amount collected with the recovery of the tip will be embedded on the payroll.
Pinto Dias, ANR, explains that the previous model the companies worked with the standard press conference, where they used a table of estimated tip to pay the costs. The estimation revolved around R monthly $400 by bartender-often value less than that collected in the period. "With the new law, restaurants can no longer do that. They have to collect on the account as additional, administer this tip, pay pay stub and, of course, afford all social obligations, social security and labor. "
To defray the costs, the new legislation provides that the restaurants included in the Simple tax regime may retain 20% of the total collected with the tip. Already working in the system of presumed profits can stay with up to 33% of the amount. In both cases, the remainder should go to workers. "So also the need of the largest value in the service charge, for which the employee is not detrimental to the change."
The partner restaurants Insalata and Terrace Insalata, Fernando Daher, goes in the same line and stated that the new Bill will generate an increase in the cost of labor, since the restaurants will have to fulfil a number of obligations higher tip. "To be able to afford them if decided this percentage that can be retained by the company. However, to compensate for the 33% that we will be entitled to only output to not reduce the remuneration of officials is to increase the service fee, "he said.
The Manager explains that the movement in the sector is because the market is worried about losing their most skilled employees to other sectors of the economy. "A waiter has, on average, more than half of your remuneration at the tip. The restaurants that choose to continue with the 10% will lose their best employees to that increase. "
The legal adviser of the ANR, Pinto Silva, points out that "the restaurants are not winning with the increase, and that is just one way of ensuring that the employee does not reduce the gains I had before."
Impact on consumers
Despite the increased need, shared by most companies in the sector, there is a concern about how this may impact on the relationship with the consumer. For Daher, the Insalata, the increase should generate an initial resistance, but that will reduce over time. "We believe, explaining the reasons for the increase, it will be well absorbed by the consumer in a period between two to three months," he says. The partner at the table, Tamil, agrees that there will be a '' nuisance '' at the beginning, and says that the way out is to make clear to the customer that this is a change from the market.
