Food labels should inform nutritional variation of up to 20%

Anvisa (national health surveillance Agency) will require food manufacturers make it clear on the label that the nutritional values reported may vary by up to 20%.
The decision of the second panel of the STJ (Superior Court) was unanimous. She would have pointed out that the right to information is guaranteed by the Federal Constitution and away the argument that the inclusion of the warning labels would cause excessive cost to the manufacturers.
After measuring irregularities in the labelling of products light and diet, the MPF (Federal prosecutors) proposed public civil action so that the Anvisa, using its power to supervise the food products, require that warning labels.
For the FEDERAL COURT of APPEAL (Federal Court) of the 3rd region (São Paulo and Mato Grosso do Sul), the variance of 20%, related to the raw materials used in the manufacture of foods, "is characterized as not relevant or essential information, justifying the insertion of warning labels.
The MPF appealed to the SUPREME COURT. According to the website of the Supreme Court, the reporter Minister Herman Benjamin considered that the consumer has the right to be informed on the label of the existence of this variation, "mainly because there is no standard of Anvisa allowing this tolerance".
